The Comment On The Deputies To The People’s Congress Full-time System

The people’s congress system serves as China’s fundamental political system, deputy to the People’s Congress mainly adopts the part-time job system in our country. How to exercise its powers,fulfill its responsibility by elected people’s deputies and play the supervisory role of the people’s deputies, is directly related to the construction of China’s democracy and law is perfect or not, people’s masters system security is guaranteed or not, national institutions whether play their roles in accordance with the law or not within the framework provided by the authority organ, whether the people’s democratic rights are actually protected or not. At present, although the National People’s Congress system has played a positive role in China’s construction of democracy in a certain period, but with the development of social economy and the progress of democracy and nomocracy, the disadvantages of full-time system of the people’s congress have become prominent increasingly.On March8,2011, National People’s Congress standing committee proposed 《About the decision(draft) of the numbers of deputies and election questions of the12th National People’s Congress on the fifth session of the eleventh national people’s congress》.It mentioned the problem of reducing the numbers of deputies and the problem of the proportion of representatives, from which we can see that the reform of People’s Congress system has become a inevitable trend of the development of democracy and nomocracy. Through the studio revoked events of Li Guoxi (National People’s Congress) of ten constitution events in2010, this paper first proposed the problem of break away from the part-time deputies to the People’s Congress and voters,the problem of excessive numbers of deputies to the People’s Congress, the problem of higher proportion of official deputies, the problem of unable to supervise other state organs more effectively and the "empty duty" problem of deputies to the People’s Congress. Then through the comparison of Senator system in western countries,it further elaborated the vote right problems about the candidates of People’s Congress in China. Eventually, this paper plans to consummate the production system of deputies to the People’s Congress’s and the assumption of duty safeguards system of full-time deputies to the People’s Congress,and establishes the resumption supervision mechanism of deputies to the People’s Congress to solve the existing problems of the part-time deputies to the People’s Congress.
