As a large agricultural nation, the good development of countryside, agriculture and farmers is the prerequisite and basis of social economic’s stability and development. All countries in the world are committed to drive the development of ’agriculture, countryside and farmers’,and to create the good development environment for them.especially to rovide a strong financial support for them.Rural Credit Cooperative is the important pillar of serving in’agriculture, countryside and farmers’,so nations pay special attention to the development of Rural Credit Cooperatives.The development of China’s Rural Credit Cooperatives has a history of more than50years, and according to its characteristics in the development process, it can be divided into five stages of development:The first stage, the stage of piloting, promotion and adjustment (The initial stage of new China to "great leap forward" eve in1958); The second stage, the stage of Rural Credit Cooperatives moving forward in the twists1958-1979); The third stage, the stage of reformjing and adjustment of Rural Credit Cooperatives (1980-1996.8); The fourth stage, the stage of developing of Rural Credit Cooperatives (1996.8-2003).6; The fifth stage, the stage of deepening the reform (since2003.6).Although the reform of Rural Credit Cooperatives in each stage has acquired some achievements, but still there are problems such as undefined reform targets, departure from the original intention cooperative system, the rigid management system, unsound internal control system, backward legislation.One reason of the causes of these problems is unclear current laws and regulations on the legal status, property rights system, corporate governance structure of Rural Credit Cooperatives.The author embark on analysis from the legal status, property rights system, corporate governance structure of Rural Credit Cooperatives.and demonstrates the conclusion that China’s rural credit cooperatives are special cooperatives legal person, and this provide premise and foundation for further definiting and optimizing the property rights system, and the corporate governance structure.At the same time,we can reference advanced legislative experience of rural cooperative finance in developed countries, combing with the special conditions of the development of Rural Credit Cooperatives.and come up with suggestions on improving China’s Rural Credit Cooperatives legislation.
