The Empirical Analysis On Legal Authority Of People’s Governments At The County Level

The rule of law requires people’s governments at various levels promote administration within the limits of authority according to law in terms of constitutional and legal provisions.Now that the law endows to the people’s government at the county level administrative authority, and also lists ten reference contents of authority.As long as we contrasted the statutory authority of the people’s government at the county level to its actual situation of performing duties some problems will be found.How to make the investgation simple effective and persuasive.Having used the empirical analysis method, the author choose Changsha county in Hunan province as the study case,through investigating its government work report, to find the differences of the statutory authority of its government and its present situation.In the next step, exploring reasons and putting forward reasonable countermeasures has become the train of thought. Changsha County,as a county of middle and western China, belonging to Hunan province, has developed economy and its degree of government by law is higher.Through the investigation we can search for some prevalent questions of the people’s government at the county level in its performance of statutory authority, which has high representative and typical significance.Full text includes introduction and three parts. In the preface part, the author put forward the basic view of thesis, namely analyse carefully, research and solve the all sorts of problems of people’s government at the county level in the exercise of performing statutory authority,which is the realistic need and inevitable choice to ensure the people’s government at the county level perform administration according to law and to construct a socialist country under the rule. The first part makes a comprehensive theoretical introduction to the connotation of the authority,summarizing respectively the connotation of the authority;the relation between the government authority,the government function and the government responsibility;the source of authority of the people’s government at the county level. The second part is combined with the realistic case of exercising status of authority by empirical analysis,through the government work reports in recent years of Changsha County, so that find out the problems and analyze reasons and puts forward the countermeasures for the next step prepare. The third part first has specified the dislocation the offside and the absence of the authority of the people’s government of Changsha county that it exercised,then from the legislation setting, awareness of the rule of law, the ideological understanding and the function of survision to the current Changsha people’s government at county level. At last the author puts forward several countermeasures to the problem of the people’s government at the county level in the performance of their statutory authority. Therefor the following three countermeasures and suggestions: improving legislation to clear the authority limits;combining "the soft" and "the hard" to strengthen government soft environment construction;preventing external to strengthen the supervision of People’s Congress at the county level to the authority of government.
