| With the gradual deepening of economic globalization, the corporate socialresponsibility arouses extensive concern from all sectors of the society. Internationally, theUnited Nations officially launched the “Global Compact†program in2000. Internationalorganization for standardization launched the formulation of the social responsibility ofinternational standard ISO26000in2004. Afterwards, some multinationals also laid down theproduction rule of social responsibility and published the report of relative socialresponsibility, which presented the new global trends of the implementation on socialresponsibility.Meanwhile, our country is also giving more and more emphasis on the implementationwork of corporate social responsibility. In China, as the article5of the renewed company lawin2006asks explicitly:“Companies in conducting business activities must conform to lawsand administrative rules and regulations, observe social ethics and business ethics, be honestand trustworthy, accept the supervision from the government and the public and implementsocial responsibility.†General Secretary Hu Jintao specified explicitly in the Central Work ofEconomic Conference at the end of2006:“We should not only continue to improve theincentive mechanism of enterprises, but also focus on strengthening its external restraint,guide enterprises to establish the modern management concepts and undertake the socialresponsibility indeed. With the deepening of Chinese state-owned enterprises’ reform, ourcountry attaches more importance to the social responsibility implementation of Chinesestate-owned enterprises. In2008The State Property Committee of State Council introduced“Guidance on Central Corporate Social Responsibilityâ€. It can clearly be seen that to activelyfulfill their social responsibilities for the state-owned enterprises has been the earnestexpectation of the community and a wide range of requirements. At the same time,state-owned enterprises fulfill their social responsibilities actively is of great significance forbuilding a harmonious society in China.This paper discusses Chinese stated-owned enterprises’ legal Systems of state-ownedcorporate social responsibility. The full text first analyzes the basic theoretical issues ofcorporate social responsibility, and then points out existing problems in performance thecorporate social responsibility and the reasons for the formation on the basis of clarifyingrelated concepts. The text as well draws some of the practices and experiences from thedeveloped countries and developing countries in practice of corporate social responsibility implementation. It is around the three dimensions of enterprises, government and society,combining with the actual situation of China’s state-owned enterprises. It analyzes theimplementation of Chinese state-owned enterprises social responsibility layer by layer fromthe legislation, law enforcement, judicial supervision and other aspects of China’sstate-owned enterprises to fulfill their social responsibility, and summarizes the legal issuesthat may arise in these analysis processes. This paper finally puts forward accordinglyimprovement measures. |
