The Case Analyse Of "Tour Guide Horse" Cross-border Fraud In A City Southwest Of China

The development of cross-border tourism is a large and bright features about A city’s tourism, but in recent years with the notice published by the country which will stop applying the outbound tourism business card in different places, it caused a huge impact to A city’s cross-border tourism industry. Some unscrupulous criminals began to use the banner of "tour guide " guise, in A city’s bus station, hotel and the port to attract tourists, using theirs’ curious psychology, enticing them to travel abroad, then engaged in doing the illegal and criminal activities and invasion the tourists’ legal rights. The essay will analysis the molecular large "tour guide horse" transnational fraud which occurred in2008leaded by the defendant:Huang Jia, Huang Yi whom from A city. The case attracted the social attentions, amount of:the crime, the defendant, the victim number was huge. The author use the substantive criminal law、criminal procedure law and some related legal perspective to analysis the case and the case in dispute. Then put forward some legal basis to handle the similar crime. Combined with the characteristics of such cases, finally the author gave some enlightenments about the preventing and controlling such cases occur again.
