On The Protection Of Empty Nestle Seniors’ Rights

Accompanied with the reality that the aging population grows rapidly and the influence of those people getting old before being rich, China is facing many problems. The economic activities participated by the seniors are not optimistic. The large number of the seniors brings unprecedented difficulties and pressures to the traditional Social Security System and so on. "Universal Declaration of Human Rights" says, " All human beings are born free and equal in dignity and rights. "Everyone, as a member of society, has the right to social security and is entitled to realization, through national effort and international co-operation and in accordance with the organization and resources of each State, of the economic, social and cultural rights indispensable for his dignity and the free development of his personality. "Certainly, protection of the seniors’rights should be emphasized. At present, the increase number of empty-nest seniors makes it a much urgent problem to protect the seniors’rights. Both cities and countryside have many empty-nest seniors and neither of them have the same strategies to protect their rights, for instance, lacking spirit comforting is widely existed problem of unban empty-nest seniors and their children need to pay more attention this; and countryside empty-nest seniors need more material help for the daily life which can be improved by proper and effective Social Security System. Thus, we need analysis in detail to make proper strategies.The protection of empty-nest seniors" rights has become the most urgent problem to be solved at present and in the future in our country. Pension, has been quite a problem for a long history and lacking both life care and spirit care is an indisputable reality during the endowment. Respecting seniors is the traditional virtue of our Chinese nation. During the long history of our Chinese Civilization, it always appeals for the family harmony and respect for the moral. However, there are so many problems in front of us:how to protect the senior’s rights in the maximum extent? From the perspective of law, the writer tries to analyze the problem of empty-nest seniors and find effective strategies to protect nest-empty seniors’ rights. This paper consists of four parts, the first part defines the "Empty Nestle" and analyzes the meaning and reasons for the existence of the Empty Nestle Seniors. The second part mainly discusses the status quo of the protection of the Empty Nestle Seniors’rights, the current problems and legislation, i.e. the articles of law about seniors’rights protection and their drawbacks. Based on the analysis of the articles, the author discusses the shortcoming of the relevant legislation and the imperfection of the system. The third part analyzes the legislation about the protection of the Empty Nestle Seniors’ rights in foreign countries and provides some good experience. In the fourth part, according to the analysis of the current problems about the Empty Nestle seniors’ right protection, the author gives some suggestions on how to protect the Empty Nestle seniors’ rights.
