The Study Of The Value Of Current System Of Concealment Among Families

S"ystem of "concealment among families was one of chi’nas ancient legalsystems and essential ethical principles which last for thousands of years. This systemcould be traced back to the XiZhou dynasty when it was a moral principle with asimilar name. It required the harmonious relationship between father and son, amongbrothers. And at that time the emphasis of family ethics was an important premise ofthe stability of family and country. Only if the basic ethics between families are fullyunderstood and incepted to the people, the stability of family and even the country asa whole was not to be threatened. It was Confucius who explicitly mentioned thetheory of “concealment”among families first. With the authenticity of Confucianismand the Confucian influence on law, the concept of concealment is accepted by theruler in Xihan dynasty and embodied in law. Later on, the law of all dynastiesbasically continued the use of this concept and perfected it during this course. It hadbeen the essential legal system in feudal society. However, after the establishment ofPRC, due to the attempt to abolish the old social order and establish a new socialistcountry, th“e system of concealment among famili”es was entirely eliminated anddenied the value of its existence as feudal dross. It went absolutely against the basichuman nature and family ethics, leading to the conflict between law and moral whichcould not be ignored. Currently, the increasingly serious problem of moral decline andthe indifferent relationship between family members as well as the absence of moralresponsibility are all closely related to the denial of system of “concealment amongfamilies" and ignorance of traditional cultural value. Therefore, the discussion ofre-measuring the value of this system in the construction of a harmonious society andthe role it plays in serving the whole social system has become an important task intheoretical research. This paper consists of three parts: preface, body and conclusionand the body is composed of four chapters.The preface summarizes the writing methodology and theme of this paper.The first chapter introduces the system of "concealment among famili"es. It ismade up of two parts. The development of the system in each stage is introduced byhistorical materials and leads to the explicitness of its meaning. Meanwhile, the reason why it exists is also discussed in this chapter.The second chapter discusses the Communitairanism and Confucian ethics. It isalso made up of two parts and mainly discusses the major theoretical views ofCommunitairanism and the connotation of Communitairanism and Confucian ethicsand inner relationship between the two theories.The third chapter makes a research on the value of system of "concealmenta"mong families. It is made up of three parts and analyses the value of this systemfrom the three respective perspectives of individual, family, society and country.The fourth chapter deliberates the introduction of system of “concealment amongfamili"es. It consists of two parts. The first part states the reason and current situationof the denial of this system and in the second part, some necessary innovations andrules about the introduction of this system are presented.In the conclusion part, the conclusion is drawn from the above discussion. It alsostates the necessity of study the value of this system and anticipates the role it willplay in the society.
