The poor quality health legislation of protection of the right to health has becomethe common concerned issue; this paper was to explore the evaluation indicatorsbefore legislating and before quality assessment after legislating of the right to healthprotection legislation and to improve the quality of health legislation, ultimatelyimprove the health of our citizens.This research considered that simply rely on the existing evaluation criteria isdifficult to correctly measure the quality of the legislation to the right to healthprotection through discuss the evaluation criteria proposed by different scholars in thefield of evaluation of the quality of legislation. The health rights protection legislationin the field with particularity, the particularity of outstanding performance in advanceto protect the right to health, however, evaluation criteria of the quality of legislationis more focused on the post protection.In view of the quality of the evaluation of the right to health protectionlegislation can not simply rely on the existing evaluation criteria, so explore whatindicators to evaluate the right to health protection legislation and ultimately improvethe quality of the right to health legislation become the inevitable choice. And, theimprovement of the quality of the right to health legislation should focus on twoaspects: on the one hand, the adoption of a scientific and rational indicators to guidethe right to health protection legislation before Law-making.These indicators aredivided into the form of evaluation and substance evaluation, which forms theevaluation is to protect the integrity of the system and protection of thecomprehensive, substance indicators are the fair allocation of health resources, inadvance to protection and post-relief, n advance to protection are divided into theavailability of resources for health, availability, acceptability and quality of health resources.
