Water is an important element of the ecological environment, a vital resource for humanbeings’ living and production and a crucial material for economy development.China’s total amount of water resource is2812.4billion cubic metre, ranking the sixth of the world. However, the per capita water amount in China is only2200cubic metre, about a fourth of that of the world. The limited amount, the uneven distribution, water pollution, water squandering has jointly posed a shortage in water resource, which has turned out to be a key element restraining our country’s economy development. Our country has been included in the thirteen countries with meagre per capita water resource. Therefore, water resource optimal allocation has become an urgent matter. Since the publish of the article Our Country’s First Water Property Rights Transaction Concluded in People’s Daily, which has reported the purchase of the perpetual right of usage by Yiwu from Dongyang of50million cubic metre of water with200million, water right has again become a hot issue following the discussion over the transaction of land use right.Since the water right transaction system has been in its early stage, foreign experience has to be used for reference. We have to adjust measures to local conditions, suit the remedy to the case, and establish water right transaction system with Chinese characteristic. The analysis of Dojiang River water right transaction, has to take local economy, the need for social development and the need for local people’s living into consideration. Dojiang River water right transaction is conducive to the allocation of the Dongjiang River water resource and the protection for Dongjiang River’s environment. From a bigger perspective, it is conducive for establishing water resource market system with socialist characteristic, south water to north of solving the water right dispute and water benefits allocation problems arising from supplying water to places with meagre water resource with economy methods. It is conducive for developing a reasonable system of using, saving protecting water resource, and for the sustainable development of water resource.
