Research On Legal System Of The Development And Management Of China’s Shale Gas Resources

As a new energy, shale gas could effectively change the energy shortage situation,it has been a global concern. All countries have involved in the development of shalegas resources. Shale gas resources is rich in China, the survey and exploration of shalegas resources is still on the initial stage. There are not relevant policies and legalsystem of the development and management of shale gas resources, which will bedetrimental to the development of shale gas resources in China.In this paper, the development and utilization of shale gas resources as abreakthrough point, it analyzes the related laws and regulations of the development ofthe shale gas resources in United States. It makes a comparative analysis on UnitedStates’ related legal system of the development and management of shale gasresources and China’s current legal system of the development and management ofshale gas resources, and finds out the difference between the different legal systems oftwo countries. Combined with China’s actual conditions, to build China’s legal systemof the development and management of shale gas resources within the framework ofthe existing legal system, and contribute to the development of shale gas resources.This article includes six chapters.The first chapter mainly introduces the researchbackground and significance of this paper, and overviews the research methods andresearch purposes of this paper;The second chapter introduces the shale gas resources,overview the global distribution of shale gas resources and the strategic value of thedevelopment of shale gas resources,analyzes the situation of exploitation of shale gasresources in United States and China;The third chapter outlines the legal system of thedevelopment and management of shale gas resources, including mineral lease system,environmental impact assessment system and the state government legislation andpractice of the development of shale gas resources;The fourth chapter makes acomparison between China’s and United States’ legal system of the development andmanagement of shale gas resources, mainly for the mining rights system, waterconservation system in the development process of shale gas resources, environmentalimpact assessment system in the development process of shale gas resources;The finalchapter constructs the legal system of the development and management of shale gas resources, Including mining rights system, water conservation system, environmentalimpact assessment system, emission trading system and emission charging system.
