China is a resource and energy consuming countries,but also a big country producesolid waste.Solid waste pollution and air pollution,water pollution and nosie pollutionconstitute the four major pollution nuisance.With China’s sustained economicdevelopment,industrial solid waste and garbage,etc.increased dramatically.This hasbecome a great source of pollution affect our environmental health.The situation ofsolid waste pollution is quite bad.2005issued a revised “the People’s Republic ofChina Solid Waste Pollution Prevention Law”(hereinafter referred to as the “SolidWaste Law”),however,the principles established in Article III of the Act,such asreducing solid waste generation and hazardous,fully and rationally utilizing solidwaste,and disposal solid waste without harmless hasn’t be better complianced.Atpresent,the situation of China Solid Waste Pollution is still grim,but the level of solidwaste management is sill infancy.Therefore,legal measures of municipal solidwaste,is one of the problems to be solved in our legislation today.At present,formulate and improve laws and policies,build the legal framework ofthe municipal solid waste reasonable,accelerate the construction of resource recyclingand reusing system,this is an effective way of reforming the urban solid wastepollution prevention and control work.There are still many aspects should be inprovein our municipal solid waste pollution and control legal system.Such as add theconcept of circular economy into the singal law of Industrial solid waste pollution andprevention and control. On garbage,we should establish separation and recoverysystem and clear all legal responsibility.Strengthen the resources of the legislativeactivities of Hazardous waste.In order to achieve the purpose of the legal managementof municipal solid waste in China, government must use legal and market-oriented,standardized means of government, enhance the people’s solid waste managementawareness.Thereby achieve the sustainable development objectives ofeconomic,social and environment.The key part of municipal solid waste disposal iswaste recycling,this has strategic significance for us to build a “resource-saving andenvironment friendly society”.
