Climate change presents serious threats which will affect natural system and human system in the world. Because of the importance, biodiversity can be said to be the basis of the development of the human, but, it has been affected seriously by climate change. So, how to deal with climate change to protect the biodiversity, reduce the damage by climate change, has been a new problem for the experts and nations in the world. As necessary response to cope with climate change, the law and policy about climate change that how to adapt become very important. There are two basic ways to prevent and reduce climate change effects, one is mitigation which stabilizes greenhouse gas in the atmosphere, as the effective measure to deal with climate change, mitigation is studied by many scholars in the world; the other is adaption which improves adaptive capacity to climate change. Climate change is a long-term and irreversible process, it is changing much faster than the speeds which biodiversity itself adapt the surrounding environment, so, choose adaption to response climate change be a wisely issue.As the necessary measure to address climate change, adaption becoming taken seriously by scholars in recent years. But, compare with mitigation, it is not enough, especially on the study about biodiversity adaption. So, how to prevent the influence and protect the biodiversity is a necessary problem.On the background of climate change, the thesis analyzing the relationship between climate change and biodiversity, introduce present situation on protect biodiversity in China, then propose the necessary and the way on adaptive biodiversity protection. Simultaneously, the thesis introduce the legal policy about protect biodiversity in China, analysis the flaw of legal policy on adaptive biodiversity protection. This thesis not only introduces the situation in China, the more important is the cases on Kenya, Bhutan and Bangladesh. At last, talks about how to resolve the issues raised and proposed proposal.
