A Research Of The Establishment Of Collective Property Right In State-owned Enterprise

On the process of promoting the establishment of modern enterprise system in state-owned enterprises, we blindly copied the experience of joint-stock reform from the West and over emphasized material capital property—especially the effects and benefits of sate-owned capital but forget the socialist nature of state-owned enterprise. Moreover, we neglected the right and interests of the workers of state-owned enterprise, which weakened the master status of the workers of state-owned enterprises. Then, how to deep the reform of state-owned enterprises? Fist of all, we should started from the property rights system of state-owned enterprises and the ownership structure. But about the question of "how to change", great controversial existed among the theoretical workers. In a word, the purpose of the reform of state-owned enterprise is to optimize the state-owned capital, to keep and increase the value of state-owned capital, to let those state-owned enterprise play a better leading role in national economy.This essay believed the mode or theory of the state-owned enterprise reform should have the nature of reality and feasibility, that is, the determination of reform mode must not separate from the present system environment of our state-owned enterprise (for example, public ownership should takes the leading role, workers should takes the master status ). This reform should not only analyse the property structure of state-owned enterprise, but also analyse the property right,should not only consider if the dividing of property is clear in different principal, but also consider whether does the property have the feature of integrity. Promoting modern enterprise system in state-owned enterprise doesn't mean promoting the single capital property system, other property should be considered, particular the property of the workers'.This essay is dedicated on the research of collective property right of state-owned enterprise. Based on the special nature of our state-owned enterprise and the conditions and requirements for its development, this essay try to discuss how to establish the property system of state-owned enterprise, according to the actual situation of Chinese state-owned enterprise, and associated with western theory of modern property system. By discussing the nature of state-owned enterprise, we revealed the source of collective property right from the angle of the remaining cooperation, the exclusive resource of enterprise and the public domain. This essay criticized the flaw in single capital logic, and advocated a mode in which capital and labour participate in corporate enterprise governance. Thus proved a point that material capital owner should no longer exist in a form of the only strong property right, and the labour should share the claim right and control right of surplus value through the human resource property right and collective property right. On this basis, the essay try to discuss the structure of the rights of state-owned enterprise and the design method for ownership structure, governance and profit distribution. So, building a united property rights that combined with elements property right and collective property right is the best way out.
