Legal Thinking About The Recessive Interview

Recessive/Hidden interview is a special method of modern news interview, but because it uses a secret way , and the interviewees will not be informed and noticed before the actual interview, along with many other reasons, it has led to much controversies between the scholars and the journalists, as well as legal problems.In order to further explore the legal issues of recessive interview, this paper begins with the concept, characteristics, origins, and status of recessive interview, together with the use of current status and communications. Finding out why recessive interview provokes many problems, but at the same time, it still exists and favored by many journalists. Second, this paper discusses how recessive interview is defined on the legal level, and how the law sees and treats the recessive interview. Third, this article especially focused on the infringement of human rights of the interviewees under many cases, and how the news media defense themselves after the cause of legal problems. And that provides a sign of existence for the recessive interview. Last, this paper briefly discussed how to avoid the infringement from the recessive interview.Overall, although recessive interview has always been questioned, and the interviewees has always felt expressively dissatisfied about the recessive interview, but more importantly, the recessive interview has always been criticized by the law. However, in my opinion, recessive interview has its needs to exist in the present stage of China. Also, its power of communication is very obvious. Therefore, I suggest the news media and the journalists should apply the recessive interview within the permitted area by law. And even if the recessive interview caused lawsuit, the news media could also defense themselves. Of course, the defenses cannot be used to against any human rights, but we should be very clear that it is legal for us to interview under some special cases. Even though it causes lawsuit, we have enough reasons to defense ourselves.
