The police of higher school running independently are China's higher education development to explore ways of higher education, promote legal process and the construction of the characteristic of the modern university system is an important content of China's higher education, for the strategic development of significant and profound significance. Throughout more than thirty years of the reform and opening up, the reform history of higher education system is actually run independently explo- ration history university .At the end of 20th century, the government with the way of education legislation had established the principles of higher school running indepen- dently, gave legal person status and endowed related school-running autonomy to higher schools. However, the police of higher schools running independently charact- erized by legalization, diversity and personalized is still hard to realize effectively.In this paper, based on the relative contents of autonomous running of school summarized in the perspective of jurisprudence and combining the relative laws and regulations, the right capacity and behavior capacity of autonomous running of school in the current public university are analyzed. At the same time, through comparing with the right capacity and behavior capacity of Japanese national university corporation autonomous operation, it is pointed out that the behavior capacity plays a key role in the university autonomous running of school. Then the strategies and suggestions to increase university autonomous running of school and realize the university autonomous running of school are proposed.
