Legal regulation concerning employment discrimination is a worldwide topic, and many countries are making efforts to explore this aera. Employment discrimination also widely exists in our country, but both our current legislation and theory lack of sufficient attention to this problem. The theoretical identification of employment discrimination has been limited to the scope of direct discrimination, and legislation still has room for improvement. Using comparative analysis, specification analysis and empirical analysis, this article studied laws and regulationgs of employment discrimination.This article was divided into the following four sections.The first section mainly focused on the definition and identification of employment discrimination. By studying standards of employment discrimination, this section introduced the division of direct discrimination and indirect discrimination innovatively, broadened the definition of employment discrimination, and pointed out that not all differential treatment belonged to discrimination.The second section mainly introduced the foreign legislation on employment discrimination. This section researched into the relevant legal regulation of the International Labour Organisation, the United States, and the Netherlands, discussed their legislation modes, basic theories, discrimination types, allocation of the burden and relief agencys, and comparised among some legal regulation for reference.The third section mainly studied the legislation and the insufficiency of our anti-employment discrimination legal system. After summarizing the primary employment discrimination factors, studying our current employment discrimination legal regulating system, this section pointed out the deficiency of our employment discrimination legal regulating system.The fourth section put forward some suggestions on perfecting our country's Legal regulation concerning employment discrimination. Formulating a unified "anti-employment discrimination act", expanding the application of anti-employment discrimination law, setting specialized agency for employment discrimination legal regulating and broadening relief ways to employment discrimination, were four aspects for constructing and perfecting relevant law system.
