Discrimination in employment is a widespread international problem,its existence can be explained by many reasons involving social,economic,political,cultural,legal and other aspects.So,the relevant researchers all over the world exert advantages of respective disciplines,including sociology,economics,law,anthropology and so on,to analyse massive phenomenons of employment discrimination.They are committed to an integrated approach from a number of measures to solve this hard problem of the world.And based on international experience,setting up the legal system of anti-discrimination in employment is a good choice among many effective stratiges.Now,legislation of anti-discrimination in employment,particularly the formulation of special antidiscrimination in employment is very popular in the world which has gained strong advocacy of the United Nations,the European Union,the International Labor Organization and a number of NGOs.However,in China,there are a large number of various kinds of employment discrimination existing in the job market,and being very harm to our society, while an effective legal system anti-discrimination in employment has not established.The existing relevant laws and regulations in dealing with employment discrimination are so weak that can not well protect the employees' equal employment rights,and even there are many institutional discriminations in employment.As a result,a growing number of experts,representatives of the NPC and other people strongly called on that legal system of anti-discrimination employment based on the reality of China should be developed as soon as possible.In this regard,I also fully agree.And this dissertation can be treated as the author's support of legislatin in anti-discrimination in employment.In addition to the introduction of this article,the dissertation is divided into five parts. In the first part,first of all,the definiton of employment discrimination which has been internationally recognized as the most authoritative one is introduced.What's more,give simple analysis to the comprehensiveness of the definition.Then give main examples of employment discrimination based on natural factors and social factors.In the second part, after the legislative overview of the international anti-discrimination in employment,It's a focus on what we can learn from the international legislation of anti-discrimination in employment to improve China's anti-employment discrimination legislation.The third part includes the legislation's sources of anti-discrimination in employment in China and its characteristics.Partâ…£analyses the defects in China's legislation in anti-discrimination in employment.The fifth part,learning from the international legislation experience of anti-discrimination in employment and concerning the defects in China's legislation in anti-discrimination in employment,some proposals are given to improve China's anti-employment discrimination legislation a number of recommendations.
