Research On The Legal Issues Of Social Responsibility Of Coal Enterprises

As energy enterprises with high consumption, pollution and risks, Coal enterprises have its own particularity of fulfilling their social responsibility which is stricter other enterprises. At the same time, because of the principle and fuzziness of the "Corporation Law", the legal system of corporate social responsibility has a lot of problems in our Country, and consequently it is difficult to promote coal enterprises to fulfill their social responsibility by legal means. Therefore, we must establish corresponding legal safeguards and supervision mechanism to ensure coal enterprise to undertake their society responsibility practically. In order to make coal enterprises fulfill their social responsibility better, on one hand we should accelerate the separation of unnecessary social functions from the state-owned coal enterprises and cultivate the traditional state-owned coal enterprises into competitive individuals; On the other hand, we should actively urge those enterprises that haven't fulfilled their social responsibility properly to take responsibilities. It's very important to research the theory of corporate social responsibility, apply to coal enterprises, and urge them to continually enhance their social responsibility awareness when they pursue economic benefits, seize development opportunities, and finally benefits the society better.Based on the theory of corporate social responsibility, wide-range information collection and serious research, this thesis firstly analyze the existed problems and reasons of coal enterprises performing social responsibilities, elaborate legitimacy, particularity and necessity which coal enterprises should undertake for social responsibility, define the concept that, transform of economic development mode is closely concerned with social responsibility philosophy, and achievement of coal enterprises' long term benefit goal rely on their commitment of social responsibility. Then this thesis discusses their respective functions and duties of government, coal enterprise and stakeholder, push coal enterprises actively fulfill their social responsibilities by government's supervision, improvement of enterprises' self awareness and stakeholders'positive rights-protect. Finally, this thesis elaborates how to establish the corresponding legal protection and supervision mechanism to ensure coal enterprises fulfilling their social responsibility, and bring forward measures to establish legal safeguard mechanism, which defines the purpose of legislation and legal principle, establish corporate social responsibility system suitable for our current conditions, issue "Corporate Social Responsibility Law", establish specifications of social responsibility for coal industry, enhance the feasibility of the relevant legal rules to facilitate stakeholders to take a lawsuit to judicial departments, protect the rights of stakeholders by contract form, and establish the public welfare lawsuit legal system. And also bring forward safeguard mechanism outside law from policy and moral issues. Emphasize supervision mechanism for coal enterprise undertaking social responsibility from law, government, social organizations and stakeholders. Connecting the macroscopically theory of the corporate social responsibility with coal enterprises microscopically realities, it is not only the value and particularity of this study, but also the inevitable choice of our coal enterprises to implement the strategy of harmonious development and sustainable development.
