The Comparative Study Of The Sino-us Copyright Criminal Law Protection

As an important factor to the economic development of a country, intellectual property could keep a country hold the dominant position in the international competition. China's economic strength and the promotion of the position in the international world, intellectual property crime increased sharply. In recent years, the Sino-us intellectual property dispute often plagued to the criminal law protection system of intellectual property. Especially in the copyright domain of our country, the United States is expressed dissatisfaction. Although our country criminal law and the relevant judicial interpretations make a comprehensive regulation to the copyright protection, but still have many problems to be discussed further. This article tries to make a comparison of the Sino-us copyright criminal law protection with relevant laws and regulations on the basis of predecessors'experience to explore the effective ways for copyright protection.This article is divided into four parts. The first part introduces the meaning of copyright crimes to make the reader understanding roughly. The second part make a brief listing about copyright criminal law protection regulation of the Sino-us, aims to pave the way for the comparative study of the Sino-us copyright criminal law protection regulation. In the third part, the author wants to compare the different between the two countries from the guiding ideology, the legislation setting, the penalty, etc, with the above list on legal norms.
