The Perfection Of Legislative Protection Of Music Copyright In Chinese Network Environment

The copyright,also called the right of authorship,is the general term of property rights and personal rights owned by natural persons,legal persons or other organizations according to law in literary,artistic and scientific works.The invention and wide application of network technology marked that the the era of network copyright is coming.However,for the copyright owners,the network not only brings more rights to them,also brings the trouble.Therefor,the internet initiates an increasingly widespread network infringement.The traditional copyright legal protection system is difficult to solve the new problems in the copyright field of online music works.So it is of great theoretical and practical significance to study the legal issues of online music copyright infringement.This paper is divided into five parts to study the copyright protection of online music works under the network environment:The first part is the introduction,introducing the purpose of the topic and the significance of the research.At the same time,it summarizes the research status at home and abroad,and summarizes the research focus,difficulties and innovations of this paper.The second part is the overview,introducing the concept of online music works,online music copyright and the difference with traditional music works,and the significance of the establishment of network music copyright protection system.The third part is about the characteristics of music copyright infringement under the network environment.The virtual nature of the network makes the standards of infringement and infringement more difficult to determine.This chapter mainly discusses the object of infringement,the infringing subject,the infringement and the infringement consequences.The fourth part discusses the legislative status and existing problems of the protection of online music copyright in China.,discussing from three aspects: power content,collective management system and rights relief.The last part is the suggestion for the construction and improvement of the legal protection mechanism of online music copyright in China,including that improving the infringement responsibility of network service providers,further determining the scope of protection of the copyright of online music works,improving the copyright collective management system,and revising the civil remedies of the online music copyright.
