| The university act is the fundamental law of university education, which has leading function to the development of university education. Taking university as the base, it reflects the most elemental principles of university education. For the Republic of Zambia, it has attached great importance to the construction of the legal system of university since the first university. During nearly half a century after independence, it always makes more efforts to amend the university act timely and meets the demands of the times. The amendment of the university act and the reflection of university education are among the most urgent tasks in the developing process of Zambia university education. Based on the research value of the university act, the dissertation takes the university act of the Republic of Zambia as the research object, and uses the methods of textual analysis, comparative analysis and historical analysis to analyze its changing course and content. Overall, from the view of the change of the university act, the study comprehensively understands the changing trend of the university act and the process of the reform and development of university education in Zambia. Based on this, it also hopes that it could provide some inspiration to the construction of the university legal system in our country.In addition to the introduction part, there are four parts in this dissertation. The first part is the legal system and education in the colonial period. It introduces the developing situation of the legal system and education in the colonial period, and analyzes the influence of the local legal system and colonial background on the long-term backward in education. The second part is about the university act of the Republic of Zambia between national independence and the late 1980s. Based on a brief review of the establishment and amendment the university act in the first Republic of Zambia and the second Republic of Zambia, the research further discusses the history of the establishment of university and the change course of university macro management system. The third part studies the university act of the Republic of Zambia Since the 1990s. This paper mainly studies the background and content of the University Act of 1992 and the University Act of 1999 respectively, and explores its impacts on the university internal governance structure, then makes a complete analysis of the rapid development of private universities and the reformation and development of public universities in the 21st century. The fourth part is the summary and reflection of this study. On the basis of comprehensive analysis, the paper gives the definite conclusion about the total characteristic, change content, revision principle and future trend of the university act. At the end of the research, we make reflections on the Higher Education Law of the People's Republic of China according to the aspects of legislation and law enforcement, and then come up with the advice on the improvement of Higher Education Law.The main conclusions of the research include the following:1.The internal need of development for the university education and the special significance of the university education itself have determined the necessary of the rule of law to the University. The university act can not solve the problems of university fully to achieve social goals, but it is very necessary to guide the development of the University as the basis of policy decisions for the university.2. Frequent amendment according to the situation is the most obvious feature of university act in the Republic of Zambia, and its amendment trend is from the design of the university macro management system to the regulation of university internal governance structure. It hopes to shape independent and health environment under legal protection for university, and it also needs the protection of the whole society stability.3. Higher Education Law, as the basic law of higher education, should be an important law to regulate and protect the activities of higher education in our country. In order to meet the target, our country must amend and improve it timely, and ensure its obvious forward-looking and guidance quality. Similarly, the establishment of modern university system and the building of world-class university need a specialized law. There must be the appropriate and specialized university act to construct modern university system and world-class university in our country. |
