| The rise of university in the Middle Age is a critical period of history of Europe.With the economic development and commercial transformation,contradictions and disputes frequently occurred.It became clear that the society needed a legal revolution because of the poor law which was not suitable for society.Common Law lacked structure and logic,Canon Law was difficult to separate from theology,thus Roman law which is famous for its private law,was adapted to societies demands and therefore revived.Secular education played an important role in the process,especially the legal education.Along with the influence of Roman law,the medieval university developed as an independent institution and demanded some fundamental privileges to set up itself.Then these privileges gradually became the statutes of university.The statutes of university,growing with the development of the medieval university and ultimately being an independent legal system,was an important part of the medieval educational legislation.This paper is based on the perspective of the influence of Roman Law on the statutes of university,through the collection and interpretation of the texts of the statutes of university,and tries to describe the formation and development of the statutes of university and to show the process of privileges gradually becoming the statutes of university,in order to explain the secularization and privatization of education. |
