On The Legal System Of Professional And Technical Personnel Examinations In The Republic Of China

Examination, originated in China, in late Ming and early qing dynasty, the Western missionaries brought this system to the West, then the examination system flourished in the West. Later on, we completely abolished the imperial examination, the early Republican introduced our test came back again from the West and then examination became an important tool in our selection of personnel.Republic of China, the feudal monarchy had just been overthrown, the country is undone, national and social need a large number of professional and technical personnel, so the government gradually established professional and technical personnel selection tests, and made a lot of laws and regulations, this is the first time in our history with the legal system to regulate the selection of professional and technical personnel, played a positive role in social development at that time. Republic of China's professional and technical personnel examination includes examination and checking according to the ways, it was divided into higher examinations, general examinations and special examinations according to the level of the examination, it was divided into two or three test according to the procedures, it was divided into written and oral examinations according to the form of the examination, it was divided into test subjects will be and selected according to test subjects.In this paper, there is four parts to discuss the legal system of professional and technical personnel selection tests. The first part is related to the definition of the concept and background studies. Sun zhongshan advocated to make an independent examination, in his mind that, the Nanjing Nationalist Government established kaoshiyuan to deal with the Examination and formulated a series of laws and regulations to regulate examination. This paper focus on the Republic of China "Professional and Technical Examinations Act" and a series of separate regulations in examination of professional and technical personnel. The second part is the history of the examination of professional and technical personnel in our country and other countries. From the Tang Dynasty, the imperial examinations had set the subject of mingfa, mingshu, mingsuan, since then each generation has set the selection of professional and technical personnel tests though not very seriously. Since the examination system been introduced to the West, Western countries have gradually established a legal system of professional and technical personnel examinations, this article is discussed about Japan, Germany, and Britain's system. Since Sun zhongshan advocated to make an independent examination, after o lot of effort, the Nanjing Nationalist Government has established the system of examination of professional and technical personnel with law. The third part is the legal system of the professional and technical examinations in the Republic of China. This paper discusses on " Examinations Act ", "Professional and Technical Examinations Act" and a series of separate regulations in examination of professional and technical personnel, includes, medical personnel, accounting and statistics personnel examinations, agriculture, industry and mining technicians examinations. The fourth part is characteristic ,results and meaning of the legal system of professional and technical personnel examinations in the Republic of China. Even it is not perfect and it wasn't work well ,it has many meanings to the society at that time and later. Because it forms a system, to some extent to meet the needs of the community and promote the professional and technical personnel at training and selecting, and it makes the professional and technical personnel to be managed by the government, and it worth us to learn today.
