| It is known to all that agricultural production is a foundation of national development, and for China it's more important.China is one of the countries that suffers the most serious natural disasters in the world,the agricultural risk almost exists everywhere and all the time.The agricultural insurance is an effective protection of agricultural production system.Therefore,some commercial insurance companies began trying to develop agricultural insurance business.However, due to weak agricultural risk insurability,agricultural insurance dual positive externalities, makes agricultural insurance costs are high,and commercial agriculture insurance is ended.The Government began to realize the policy of agricultural insurance can only take the road.It is regrettable that although after 20 years of exploration,China has not yet issued a complete legal system of policy-oriented agricultural insurance,and restricted the prosperity and development of policy-oriented agricultural insurance in China.In order to fully illustrate the conclusion mentioned above,this thesis is divided into four parts,the concrete content of each part is as follow.Part One:Basic theory on policy-oriented agricultural insurance.This chapter focuses on defining the basic concept of policy-oriented agricultural insurance and discussing the character of policy-oriented agricultural insurance to support the policy-oriented agricultural insurance legislation by theory.Part Two:The historical development of Chines policy-oriented agricultural insurance. The author summarizes the development of policy-oriented agricultural insurance in China,that is,forepart esplore of policy-oriented agricultural insurance.The purpose of this chapter is to demonstrate that China ought to mend paces of the policy-oriented agricultural insurance legislation.Part Three:The legislative practice and experience borrowing of agricultural insurance legislation of different countries in the world.With transverse comparison and longitudinal comparison,this chapter analyzes the institutinal arrangement of agricultural insurance in the world. The author introduce several representative agricultural insurance in some foreign countries,such as USA,Japan,Spain,Philippines,Mexico,Cyprus and so on.In sum.The role of this paet is to provide a beneficial borrowing for promoting the institution innovation of policy-oriented agricultural insurance legislation in China.Part Four:The main construction of policy-oriented agricultural insurance legislation system in China.Firstly,the author discuss the principle of policy-oriented agricultural insurance legislation.Secondly,the author expatiate on the construction of policy-oriented agricultural insurance legal system in China.This paper uses methods of history and comparison,elaborates the basic theories on policy-oriented agricultural insurance,analyzes the present situations about policy-oriented agricultural insurance and the experience of agricultural insurance legislation in some foreign countires. After that,the author put forward to a policy-oriented agricultural insurance legislation system in order to exert what liitle strength the author's have for the policy-oriented agricultural insurance legislation. |
