Study On House Price Regulation Of China In Economic Law

At present, our country's real estate market is hot, estate prices keep rising and real estate transacted prices are high all around the country. State and local governments at all levels have actively introduced a variety of real estate control policies, receive some results. But in general have little effect.This paper aims to analyse the reasons of our country's high house price firstly.Based on that , combined with other countries'experiences and domestic situation ,the author try to propose some legal advices on how to control our's high house price.Firstly, this paper briefly introduce the demostic's situation of house price and structure of price, then anlyse the factors that lead to high prices.Secondly, from the basic theory of economic law and the basic concept of macro-control, the author demonstrate the importances of regulating prices.On the fundation of that ,the author analyse the successful experiences of countries (Germany, France, the United States, Japan, Korea, Singapore )on real estate control policies,Firstly, the rights of residence was proposed at the level of constitution, which subsequently established as Citizens' basic rights, and to definite the infallibility and significance of rights of residence by using constitution. In addition, Domestic law and Real estate economy promote law were constructed to orderly and intensively consummate legal system of property law. The legal property and main of domestic law and real estate economy promote law were also discussed. As basic law in the field of property law, domestic law lead real estate.Domestic law ,which emphasize protection of vulnerable groups and housing needs low and middle-income households, pursue to essence of the fair and the overall interests of society. We should to establish different the supply of housing system. different the supply of housing policy to different income families,including business house,economic-suitable house,public-rental house,low -rental-house.According to the structural pattern, this paper is composed by two part:"general"and"point"."general"contains of basic content and general question",point"detailed provisions content of business house,economic-suitable house,public-rental house,low -rental-house. Real estate economy promote law which regulated legal relations formed in the period of use of economic growth to regulate prices is to involved to the aspect of tax,rate,credit. Finally, we proposed related system should be consummated, including land system and housing registration system,housing registration system,specification of property market price system,second-hand house market and leasing house market,uphold the principle of differences,enhance the resultant of control and Strengthening the government's responsibility.
