Objectivesâ‘ By analysis on the laws and regulations summarizes the problems in the system of infectious disease control.â‘¡By analysis on the right standard problem and discuss the relationship between public rights and private rights, the citizen's basic rights can obtain the safeguard maximum limit under the legal permission.â‘¢Enhance the consciousness of law and clear the legal responsibility. Discusses how to make the legislation, judicature and law enforcement connected tighter and how to regulate the behavior of citizens more effectively, to control and precaution the infectious disease crime.Methodsâ‘ Literature Analysis Method: Make use of journals, relevant professional journals, books, full text databases and internet search engines and other ways to collect research results, and study carefully.â‘¡Case Analysis Method: Thorough analysis on cases of infectious diseases, found the problems reflected in the cases, combined with other research, and applied it to papers.â‘¢Questionnaire method: We selected citizens as the research object in the crowded area of the city, 50 questionnaires were issued, and 49 were responses validly. The effective rate was 98%. Information obtained on the survey data was statistically analyzed.Results At present, the system of civil rights protection and the legal responsibility has many problems, the problem about rights such as lacking of coordination between the health system and other systems, lacking of specific isolation provisions, lacking of long-term standards for property compensation. There also some problems about legal responsibility, such as only stipulate the civil liability in the Law on Prevention and Treatment of Infectious Diseases, the range of infectious diseases is narrow in part of the criminal law terms, causality of the infectious disease crime are difficult to be determined. In addition, the lack of legal knowledge not only affects rights maintenance, but also affects the cognition of responsibility.Conclusions This paper will make some recommendations for improvement. For rights protection system should straighten out the relationships between the sectors, concerned about the operation of laws and regulations; published or refined a specific isolation provisions; should start with the infectious diseases prevention and treatment of localized, promoting the equality of civil rights protection; refinement property compensation from legislative standards, strengthen supervision over property rights when the implementation of emergency measures. For imputation system, add administrative responsibilities, highlights of converge with the corresponding criminal provisions; expanded the range of "infectious disease" in the relevant provisions of the criminal law, and set some open provisions to adapt to new situations; in the case of criminal causation in infectious diseases found difficult, use the causality theory of epidemiology. For legal publicity education, by means of a combination of various forms, wide range and short cycle time, nonstop.
