Crime News Reports Infringing Restrictions

The right to a fair trial is the right to ask a a fair trial for a citizen whose right and oligation to be determined by the Court, this right is specified in The "Civil and Political Rights International Covenant" and the "Universal Declaration" and other international human rights laws. Crime reports play a significant role in meeting the right to information of the public,in supervising the judicial powers . but crime reporting may also violathe the right to a fair trial of defendant ,why it happens and how to prevent it is the core issue of this paper .The first chapter of the paper defines the crime reporting , list the types of it , analyzes the characteristics of crime reporting . the next step , this paper analyzes the content of the right to a fair trial , including the equal right in court , the right of "the presumption of innocence",the right of no self-incrimination and so on .The significance of defending this right is also demonstrated in this paper .The second chapter cites both positive and negative impacts of crime reporting to the right to a fair trial of defendant .On the first aspect ,crime reporting supervises investigative powers, prosecutive powers , judicial power ."secret operations" and other unfair treatment can be prevented . the negative impact of crime reporting alao exists . too much coverage to case may cause prior prejudice that public and juduges believe the defendant is guilty . prejudice may goes against a fair trial . The forth chapter focus on problem-solving , Proposing several solutions to prevent the negative impact of crime reprting . this paper suggests to improve the regulations and system , let handling bodies play a good role in regulating crime repoting , and strengthen self-discipline of media to solve the problem .
