In the 1990s, China issued and executed PRC Copyright law, and became a member country of Berne convention, therefore, the copyright exchange has been in a new developing stage. During recent years, the annual copyright licences amount to about fifteen thousand. As the intellectual products become more important in the fields of economy, copyright trade grows to be an important part of international trade and a major growth of all the countries. Copyright trade brings fruitful profits to domestic publishing houses, and as well opens a door to the world for our publishers through co-operations with overseas partners. From then on, Chinese owe more opportunities to show ourselves on a wider stage. However, international copyright trade is not only a simple economic action, but also a cultural action, and as well a legal one, and also the combination of them. Thus, studies on copyright exchange cause a lot of attention of both overseas and local scholars, and become one of the hot topics of academic researches.The thesis is not a list of all the clauses of a complete copyright trade license agreement and analysis to them, such as the type of the licnece, rights guarantee, royalties payment and application of the law, though these are necessary legal problems to which we should pay much attention, but based on years-long practice of copyright import, from the viewpoint of law, a reflections and analysis to those problems existing in nowadays copyright trade, esp., those rising as the rapid progress of new media and the laws and regulations have no rules on. The author also proposed some related suggestion with the hope to promote the progress of international copyright trade and improve the protection of copyright in China and finally further improve China's image in international publishing circles. The paper includes four parts. The first part is an introduction to international copyright trade, including the definition of several relevant conceptions such as COPYRIGHT, COPYRIGHT TRADE, INTERNATIONAL COPYRIGHT TRADE, as well as the main types of international copyright exchange and the present situation of it. The second one is about the qualification examination of the licenser and the relationship between the examination and the judicial judgment. The author also brings forward her suggestion in this part. The third part is about the review and examination of the content and translation of overseas works on website since the present law and regulations have no detailed rules on it. The last part is on copyright protection. With the serious situation of piracy and false bestseller, and based on the practice of anti-infringement, the author put forward suggestion from the judicial and legislative and administrative aspects.The purpose of the thesis is to provide some useful opinions and suggestion to guide the practice of international copyright trade, help the development of the industry of copyright industry, and finally perfect Chinese copyright law and regulations and further improve our good image of copyright protection in the world.
