The export of labor services has gradually flourished on a global scale ever since 1950 s,its major trend is to export labor from the less developed countries and regions to the developed world,from countries with an oversupply of labor to countries with a labor shortage.With the economic globalization,economic ties between countries has become increasingly closer.And due to the difference of economic development of countries,circulation of goods,capital,technology and even labor in the international market has become not only possible but also necessary,within such a context,the international exchange of labor is particularly important.China has embarked on a number of foreign economic-aid programs since 1950 s,the Chinese government has sent a large amount of technicians,health staff,and workers to those counties for plitical needs,which has laid a solid foundation for the foreign labor co-operation that has been carrying out ever since the great reform and opening-up policy.Since the great reform and opening up,especially after entering the 21 st century,labor dispatching has become more and more prominent.Labor dispatching can not only broaden the scope of employment,alleviate the employment pressure,but also can greatly improve the income of overseas workers,which could provide the impetus for the economic development of China.With a number of overseas employers increasing,worker's rights are sometimes harmed.The workers' money have been cheated by labor assignment enterprises,and their wages have been deducted or delayed by overseas employers.Which makes the protection of their rights and interests an unavoidable problem.The regulation regarding the management of foreign labor dispatching(hereinafter referred to as the regulation)came out in 2012,it was designed to protect our worker's rights,and it demands companies and institutions to take responsibility.The regulation has great implications in standardizing the labor market,bettering the labor environment,and protecting our worker's rights.However,in order to protect our worker's rights in today's international labor market,these regulations are not sufficient,it requires more support and attention from the government,the companies and the related laws and regulations.To begin with,this article aims to briefly analyze labor dispatching in 5 aspects,namely,its meaning,categories,features,the Marxist view of labor dispatching,and its implications.In addition,the article analyzed the course of development and advantages of Chinese labor dispatching through its origin,development,occurrent state,and its advantage combined with related statistics.Furthermore,it also aimed to find out the current situation of labor dispatching in Shandong Province,and reasons for the damage of the rights and interests of labors dispatched abroad by examining certain related examples and data.Through the study,we found that there are many reasons for damage of interests of the labors dispatched abroad,such as,the legislative system is complicated,the legislation is not perfect;lack of the attention from the government;business management is messy;overseas employers are limited by domestic policy,employment conditions;workers' poor awareness of the law.Finally,the article puts forward solutions from five aspects,namely,bettering the related legislation,government management,further standardizing the overseas enterprises,and enhancing the workers overall skills,with that,we hope this article could be beneficial to strengthening the protection of the rights and interests of the labors dispatched abroad.
