Transition Expression Of The Interests Of Vulnerable Groups Study

Along with the continuous deepening of reform and opening up, China is entering a period of rapid social transition, in this period,as a result of economic system's switch, industrial structure's adjustment and the benefit assignment pattern's change, part of members of different social classes degenerates into the society vulnerable groups. Vulnerable groups' massive existences, not only challenges to the value of goal of a harmonious society--social justice, but also restricts economic development, political democratization, and consensus on the reform side constraints. It has become a disharmonious factor in the process of reality of the harmonious society building.This question already caused the party and the government takes seriously, the educational world also proposes many solutions for the vulnerable groups question's solution, but in the former research, the scholars pays attention the focal point is mostly in the top-down government rescue and ethics significance moral concern, but insufficient to vulnerable groups' benefit expression, lacks of countermeasure of vulnerable groups researching from the benefit expression angle. From the author's point of view, in order to effectively solve the problems of vulnerable groups, change the disadvantaged status of vulnerable groups, to share the fruits of social development, the crucial elements is to safeguard the effectiveness of vulnerable groups'interests expression. The maintenance vulnerable groups benefit expression's validity is a systematic project, needs the government, social and vulnerable groups own high attention and joint effort. But in the former research, the educational world often is only pays attention to a vulnerable groups' part (for example city minority groups), but neglects other communities (for example farmer community), lacks studies the vulnerable groups overall the benefit expression; Also lacks the systematic characteristic in the countermeasure research, is not very thorough, only notes government's strength, but has neglected social and minority groups on its own strength.Facing this kind of research present situation, in order to effectively safeguard the interests of vulnerable groups, the paper has conducted in-depth and systematic research to minority groups' benefit expression , and has proposed some pointed countermeasure. In this paper, using the methods of political analysis from the system, in terms of analysis of the current expression of the interests of vulnerable groups in China the status quo, the main features are as follows: the contradiction between the objective necessity of the interests expression and the immaturity of the disadvantaged groups; the contradiction between benefit expression urgency and community policy response low efficiency; the contradiction between benefit expression common traits and the dispersion of benefit expression; the contradiction between the legitimate expression of interests and the interests of the non-rational expression; the imbalanced condition of vulnerable groups interior various communities' benefit power of expression. In order to effectively solve the problems of the interests expression of the vulnerable groups, the paper analyses the reasons from subjective, mechanisms, systems, legal aspects of the four-depth , argues that the limitations of the vulnerable groups is subjective reasons for the minority groups benefit expression falls into the difficult position; the imperfect of interest expression mechanism is the direct reason; obstacles of system of the development of the community is the system reason; the current our country judicature relief imperfect is the legal cause. Therefore, the author suggests: to enhance the capacity of the expression of the interests of vulnerable groups, needs to enhance the economic status of vulnerable groups, needs to enhance the cultural level of vulnerable groups, eliminates the feudal tradition the negative effect; (2) to eliminate the expression of the interests of vulnerable groups mechanism obstacles, needs to optimize the party and government's benefit conformity mechanism, solves the local authority department benefit problem, needs to construct the realizing mechanism of benefit expression, needs to open vulnerable groups benefit expression channel; (3)to remove the obstacles system of the interests expression of vulnerable groups, needs to ensure the healthy development of social groups which is representative of the interests of vulnerable groups, needs to break through the bottleneck which the social group further develops, needs to establish a comprehensive legislative social group legislation system, cultivate service registration management system, the subsidization tax revenue system, further consummates the society supervising mechanism and so on; (4)to improve the present legal system of judicial relief for vulnerable groups, needs to establish the Constitution protection mechanism, needs to improve the procedures of relief and so on.
