An Analysis Of The Causes Of Juvenile Delinquency And The Countermeasures

Currently, juvenile delinquency has shown a disturbing new trend and new features. And it is very urgent to prevent juvenile delinquency effectively. Therefore, in-depth analysis and corresponding preventive countermeasures will not only have theoretical significance, but also have great realistic significance for preventing and reducing crimes to promote the construction of socialist harmonious society. There are subjective and objective causes for juvenile delinquency including the youth, family, school and society. Juvenile delinquency prevention is a long-term and formidable task, and also a systematic project of society, which requires joint efforts of the whole society, including relevant improving legislation system, the system of administrative accountability, judicial mechanism, and the social prevention system including the youth, family, school and society. Focusing on the new trend and characteristics of the juvenile delinquency, this article conducts a thorough analysis of the causes of the juvenile delinquency, the existing problems and offers a comprehensive prevention countermeasures system on the basis of the successful experience abroad. This article consists of five chapters in addition to the introduction and conclusion.Chapter one offers a general survey of the current situation of juvenile delinquency, meanwhile. This chapter presents the definition of juvenile delinquency, discusses the differences between minors’crimes and adults crimes as well as juvenile delinquency’s main characteristics and developing trend in China.Chapter two plays a key role in this thesis. This chapter conducts a comprehensive analysis of the causes which includes four aspects:the youth, family, schools and society.In the third chapter, the successful experience abroad will be introduced and discussed, including experience from the America, Britain, Germany, and Japan.The fourth chapter intends to present the current situation of the juvenile delinquency prevention systems and existing problems. These systems include the relevant legislation system, the system of administrative accountability and the judicial mechanism.The fifth chapter, last but not least, puts forward methods to improve our country’s juvenile delinquency prevention systems including the relevant legislation system, the system of administrative accountability and the judicial mechanism. On the basis of the question from the current legislation law, judicial law and the practice of the law enforcement, this chapter discusses in detail the prevention countermeasures.
