With the emergence of human beings, punishment exists in all fields of social life as well as in society,which is no exception in education.At all times and in all lands,the thought of education, the educational system,and even the educational practice are closely connected with punishment. As a matter of fact, however one is for or against it,punishment is continually favoured by teachers in school education,particularly in primary and secondary education.For decades, in and out of China, varieties of reseaches have been performed into punishment, while the specialists operate it from a strategically advantageous angle and use too many jargons and they, in fact, are lack of experience and research. The researchers draw the conclusion with the help of their experience instead of paying attention to the analyzing of the basic theory and researching into detailed practical methods. When coming to the point how to put it in practice, we often avert to extremes in solving problems. Moreover, many only emphasize the positive side of "reasonable punishment" and concern about the negative side of "physical punishment" while never mentioning the instructive aspect.This thesis analyzes punishment in a more comprehensive and systematical way guided by the basic theory to meet the reasonablity and maneuverability, and pursue for certain effective measures to undertake punishment in an appropriate way. The key point of my view is that, however you use punishment-"reasonable punishment" or "physical punishment", it will always be instructive and harmful meanwhile. So, as for using punishment, you are to take it into consideration how to seek advantages and avoid disadvantages. Instructive as it partially is, no physical punishment is expected for fear that the disadvantages might overwhelm the advantages. On account of seeking advantages and avoiding disadvantages, teachers could focus on the management of the class to make it a strong effective one.In the paper "punishment", "physical punishment" and "punishment in disguised form" are both defined clearly in accordance with the laws and regulations and on the basis of quantities of material; then the paper falls into four parts to analyze and discuss the practice of China's primary and secondary schools punishment issue.In the first part, based on literature review through points of psychology and pedagogy on education punishment, the paper attempts to establish the positive function of education punishment by describing the necessity of punishment.In the second part, by analyzing the status of available education punishment, the paper attempts to figure out the problems in undertaking punishment in today's school education in terms of society, parents, schools and teachers. The third part, the paper analyzes and summaries the status of punitive practice in China's primary and secondary schools.In the last part, based on the previous exposition and analysis of China's primary and secondary schools, I'll improve the practice of punitive measures.In the level of function, I put up a tactics including society,school and teachers. In the level of society, we should legislate and guide the public opinion properly. In the level of schools, we should formulate the rules and put it to use and cultivate the teachers and harmonize the different interests. From the levels of teachers, we should enhance professional quality. From the angle of seeking advantages and avoiding disadvantages, I put forward the principle of legitimacy, principle of instructiveness, principle of necessity, principle of reasonability and principle of respect.
