Qing Dynasty, The Central Government Of The Republic Of Study Of Tibetan Religious Legislation

Tibet is one of the nations who have lots of people. The altiplanos of Tibet and Qinghai with close and rigorous condition give a chance to Tibet Buddhism,so religion gets in touch with politics, economy and culture, and religion became an important part in their lives. At the same time, religion is a part of nationality, every dynasty attached importance to religion. Nationality legislation toped over Yuan dynasty and Ming dynasty, the legal system that Qing dynasty commanded Tibet wih is very representational. On the one hand Qing dynasty summarized experiences and lessons and continued religionary legislation, On the other hand, Qing dynasty set up some new systemes and bring influence. Minguo dynasty invoked religionary legislation of Qing dynasty,and established systemes to temple and Lama China is a country with many nationalities,to administer religion is together with to keep unification,to safeguard national unification and minority faith right .religionary legislation is one part of Chinese legal system.There are three parts and and four chapters in the article.Chapter one: This chapter specifies the background of neoteric Chinese central government religionary legislation to Tibet region .Chapter two: Please recount briefly the law making made by Qing dynasty.This chapter introduces provisional regulations of rehabilitation matters in Tibet, law of rehabilitation matters in Tibet and Law of clearing the old maladies in Shangshang office. The three laws tell us the background, content and meaning.Chapter three:Please recount briefly the law making made by Republic of China (1912-1949) to supervise religion in Tibet area ,and then enumerate the cite in religionary management laws of Qing dynasty and the concrete content of management laws which belongs to the religion of Republic of China as well. Please focus on the supervisory system of temple and Lama when recite the concrete content.Chapter four:The inspiration to the contemporary era ,which comes into being as a result of central government's making regulations to manage the religion in Tibet area since modern times. Please clarify the experience achieved by the process of central government's making regulations to manage the religion in Tibet area since modern times , as well as the inspiration to make laws in minority area at the present age.This article aims at studying lawmaking made by central government to regular the religion in Tibet area ever since modern times ,and focuses on the research of corpus juries which used to regulate Tibet area. It makes efforts to explain the evolvement of law system which made by central government to the religion in Tibet area lengthways according to different historical period .In each period, one corpus juries will be discussed specially to reveal different characteristics of local society in Tibet at different historical period , and the practical effect and historical significance of all kinds of laws based on those characteristics above in Qing dynasty and Republic of China .At the same time, the author intends to talk some of his own opinions and understandings about significant problems which occurred in the process of regulating Tibet of Qing dynasty and Republic of China, aiming at supplementing and making over the deficiency of dissertation before .At the end of the article ,the conclusion will be made by analyzing religionary management lawmaking made by central government to Tibet religion at modern times to summarize the inspiration to the contemporary era, which produced by central government's installing regulations to Tibet religion .
