Scholars have paid close attention constantly to the administration on Tibet of Qing Dynasty. It includes both the research on the history of Qing Dynasty and that of Tibet Theory from different points of view. Historians pay more attention to the political administration of Qing Dynasty on Tibet, including the research on the (administration) of Tibet ministers, the local economy of Tibet, the cultural exchange between the interior and Tibet and so on. While scholars of Tibet Theory concentrate more on Tibet's religious policies, the conferring of Dalai and Penchen's titles as well as their travels to the interior. However, it has not been done very well on the research on Tibet's local administration from the angle of legal history, especially from the angle of a dynasty's legal system of administration, which has not even been discussed systematically.Upon the basis of the previous study, this dissertation concentrate on the evolution of the administrative legal system in Tibet practiced by the central government of Qing Dynasty in time order, through which we may find the different characters of Tibet's social history and the realistic and historic senses of the legal systems that the Qing Dynasty had put up. At the same time, this article also deal with the author's cognition and the viewpoints to some important problems of Qing's administration on Tibet, and try to complement and correct some defects of previous researches. The whole dissertation is divided into the preface, the five chapters, and the conclusion. The main problems will be introduced hereunder:The prgeface narrates characters of administration on Tibet of the Yuan, Ming, and Qing Dynasty, ever since the time when Tibet formally became one of China's administrative districts.The first chapter discusses how Tibet was merged into Qing's territory in the way of conferring title on Mongolia leader who dominated Tibet and Dalai Lama, the leader of Huang Religion in the early days of Qing. During this period, the legislation of Qing government is still something of local legislation represented in 《the Thirteen Codes》because of the separating system of politics and religion---"dominate Tibet by Mongolia noble". With the victory of "appeasing Tibet by putting down the rebellion of Zhungeer area", the Qing government kept the separating system of politics and religion and set up a new policy ---"dominate Tibet by Tibet noble", which can be represented by propping up Tibet nobles such as Poluonai. In order to set up systematic laws to dominate Tibet, the Qing government put its hand to the legislation work of the Tibet area in Qinghai province, among which 《the Thirteen provisions of qinghai rehabilitation matters》,《regulation on the twelve events of administrating Qinghai province》,《regulation of the foreign tribes in Qinghai and Xining》are mainly introduced in this part.The second chapter talks about the burst of Zhuermotenazhale rebellion in Tibet after the death of Poluonai. After his death, the Qing government published the first fundamental law of dominating Tibet---《provisional regulations of rehabilitation matters in Tibet》.In according with the law, Tibet ended the separating system of politics and religion and set up the preliminary amalgamated system of that. Furthermore, it is discussed in this part that the legislation process, the main content, the historical sense of 《provisional regulations of rehabilitation matters in Tibet》and the conditions of setting up preliminarily a amalgamated system . The author also clarifies his own points of views on these matters in this chapter.The third chapter expounds the publishing of the fundamental law of dominating Tibet in all fields ---《law of rehabilitation matters in Tibet》after the Qing government put down the two incursions of Cuoerka in 1870s, which exposed a lot of administrative defects to Tibet.
