Abstract/Summary:
Twenty-four years of Qianlong (1759), the Qing government suppressed the rebel of"Da Xiao He Zhuo",and unified the north and south of the Tianshan mountains. In order tostrengthen the jurisdiction of the minority regions, the Qing government considered thespecial nation、religion and customs of Xinjiang, on the premise of the unity of the legalsystem, with the principle of law-making by custom、revising the law in time, the Qinggovernment made a series of national legislation. These national legislations are not onlysafeguard the unity of the multinational country, promote the economic development ofXinjiang where is minority nationality regions, but also good for Xinjiang minoritynationality regions ’s stability, and they also played a very important role on thedevelopment of the social system of Xinjiang area.The main harvest of the legislation of Xinjiang ethnic is "Huijiang regulations"."Huijiang Regulations" mainly comes from the emperor’s imperial edict and the requestagreed by the emperor. It is not only suitable for the Uygur ethnic group, but also suitablefor Sichuan and Kazak.It is a comprehensiveness law that is formulated by the Qinggovernment, covering administrative, military, religious affairs management, economicand trade and so on. It is also an important part of Qing Dynasty’s minority nationalityregions’s legal system."Huijiang regulations" is divided into two parts: the previous memorial to the throneand text, totally eight volumes,134items. Although it is the sub-volume, but eachvolume’s substance is not logical. The first five volumes mainly consist the Burke’s set、promotion、demotion, and the limit and preferential treatment of Burke by the Qinggovernment.The last three volumes are related to the economy and trade, ethnic andreligious relations and so on.They also consist the items about Burke’s power limit.The main purpose of study Xinjiang’s minority legislation in the Qing Dynasty isputing forward valuable suggestions for the contemporary society in the minority areas oflegislation. First of all,when drafting the law, we should base on the specific situation inminority areas,and respect the custom. Secondly, with the change of social development,current affairs, we should make the corresponding changes, to ensure effectiveimplementation of minority legislation. Finally, it is very important to improve thesupervision mechanism, fight against corruption, building a clean environment for theimplementation of ethnic legislation.
