With the development of breeding technology and biotechnology, new varieties of plants with high yield, high-quality and other fine genetic characteristics have been cultivated. These new varieties have become the important reasons to improve yield and quality, and the important symbol of agricultural science and technology strength. But, the breeding of new varieties always needs long time and great financial, and propagation of plant varieties may also make it easy of use and reproduction by others.To protect the rights of breeders, in 1961.12.2, The Protection of the International Convention of New Varieties of Plants subscribed in Paris, and The International Union for the Protection of New Varieties of Plants (UPOV) established. Now, there are 65 members of UPOV.UPOV Convention revised in 1972, 1978 and 1991, and formed in two effective texts of 1978 and 1991. With the continuous development of our country's economy, voice of requirements of China's accession to 1991 text of the world's major developed countries are more and more strongly.Innovation of my paper is that analyses the feasibility of our country's accession to 1991 text from the legal points. All the materials about the members of UPOV come from the Official website, and assure them timeliness and accuracy.My paper divided into six parts.First part: IntroductionSecond part: summarization of protection of new varieties of plants.Third part: comparison of two texts of UPOV.The fourth part: introduction of members of UPOV.The fifth part: the feasibility of our country's accession to 1991 text.The last part: conclusion.
