In the background of economic globalization, the protection of intellectual property has become an important factor for national economic development and international competition. And the protection of new plants varieties belong to the intellectual property system is a basic system for the market economy. My country is rich in plant resources, which offers prerequisite for our long-term development of biotechnology. But the protection system of new plant varieties in my country was established in a short time, the protection of new plant varieties is still in the initial stage of development. With China's accession to the World Trade Organization further reform and opening up is not appropriate in the system of the protection of new plant varieties. we should establish and improve legal measures of protection of new plant varieties as soon as possible, in order to cope with the opportunities and challenges of WTO , promotion China's agricultural technological innovation and preserve our legitimate rights of intellectual property of new plants varieties.According to intellectual property theory and features of activity protection of new varieties of plant in agriculture, the essay introduced the development on the protection of new varieties of plants against background at home and abroad. The essay sum up the advanced management experiences on Protection of New Varieties of Plants. It also raised questions and challenge we are facing by contrasting the development of our country with that of developed countries. In the end, it concluded that China must learn the advanced practice from other countries to enhance its protection on New Varieties Plants.
