The protection system of Employee Breeding’rights is originated in the western developed countries,It spread to the world by UPOV convention.At present,there are two kinds of rights protection system for job breeders in the world,one kind is employers protectionism,such as Germany,Japan.the other one is the employee of protectionism,such as the United States.Nowadays,About 90% of the world’s seed resources are mastered by Monsanto who among 10 companies headed,Developed countries represented by the United States,strengthen Employee Breeding’rights protection as its seized in agriculture,the economy and maintain an important strategic measure of international competitive advantage,Promote the process of globalization of plant new variety rights protection system,In order to achieve its national interests in the global expansion.With the development of science and technology,transgenic technology application in plant breeding will be more and more widely,the transgenic plants economic role in the future will be very important,although our country present stage can keep rights to employee breeding state,but in order to promote the development of transgenic technology and breeding technology in China,our country must improve the system of rights and interests of the breeder to encourage the innovation of breeding technology,The State Council proposed to 2020,to build our country into a country with a relatively high level of intellectual property use and protection and management,The new plant varieties protection ordinance in 2013 in China is also modified,a draft of service invention also have issued to the society by countries,Although these measures have a positive effect on perfecting the rights protection system of our job breeders,but there are some problems and shortcomings.By comparing the protection of the rights of job breeders in various times and in various countries,Understanding the connotation and development direction of the rights protection of job breeders,analysis the employee breeding rights protection’s problems and the status quo in our country at present,put And puts forward some valuable suggestions on the construction of the system of job nursery rights and the related defects.
