Administrative Decision-makers Responsibility

Nowadays China, in a transitional period, faces much more austere challenges, so there is much discussion on the issue of governmental role and value orientation. After the 1970s, governmental reformations were sweeping all over the world, among which the most striking one is the market mode of governmental administration advocated by New Public Administration thought. This requires people think further the position of government. Then, the problem of governmental responsibilities became the theoretical front of academic research and the practical questions all the countries and people pay close attention to. In the global trend of innovating governmental system and establishing responsible government, the problem of how to establish a responsible government with Chinese characteristics is also been actively explored in China's academic field and many governmental organizations.Administrative decision is the process which is carried out in the course of administration management, and is the core of it, to execute administrative decision-making authority. As we all know, it is men who do the decision-making. The value orientation of the citizens under a democratic government ruling by law decides that the administrative decision-makers should perform governmental policies according to law and through a democratic process. Meanwhile, they should also take respective responsibilities. The responsibilities of the administrative decision-makers are a multidimensional system including their legislative responsibilities, political responsibilities, administrative responsibilities and moral responsibilities. Influenced by quite a few of factors, the administrative decision-makers hardly have fulfilled their responsibilities, both positive and negative. So that a vicious circle caused by this occurs, which not only bring negative effect on the relation between the public and the government, but also is harmful to the implementation of legal government polices. In order to make the administrative decision-makers take their responsibilities, it is essential to combine culture together with legislative laws and rules to restrain their responsibilities.Three chapters are included in this paper. The first chapter is to talk about the premises of realizing the responsibilities of the administrative decision-makers. That is, the meaning of the responsibilities of the administrative decision-maker and the theoretical basis to implement the responsibilities of the administrative decision-makers. The second chapter analyzes the difficulties existing to carry out the responsibilities of the administrative decision-makers: the influence of traditionally negative cultures, the bad administrative management and the legal loopholes. The last chapter which is the core of the paper, depicts the ways to implement the responsibilities of the administrative decision-makers: creating a cultural environment, improving the responsibility system of the administrative decision-makers', strengthening the construction of administrative decision in terms of legislation and improving the system concerned with the implementation of the responsibilities of the administrative decision-makers.By combing the methods of theoretical analysis, systematical analysis, and concrete analysis, this thesis puts emphasis on analyzing the difficulties existing to carry out the responsibilities of the administrative decision-makers and gives the ways to implement the responsibilities of the administrative decision-makers.
