Ever since the Qing dynasty, China has taken great measures to transplant the legal system, renovated its legislation and constructed its own legal system. But it wasn' t successful in establishing a law-ruling country. The root cause of that lies in China' s lack of social structure for the growth of legislation. Surely, on the way to build up a law-ruling system in a country, the legal system should be reformed, but the design and operation of the legal system need to lie on corresponding social basis. However Middle Class is rather indispensable to the social basis for the growth of the legal system construction. And now the new social layer structure is coming into being, thus forming the important social basis for China' s legal system construction,The inherent relevance between the forming of Middle Class and the legal advancing process is seen from the evolution of Middle Class. Their hope to establish law order to protect their own rights in lawsuit and their unique character of the legal culture work together to decide that they are of great significance for the healthy growth of law order in China. The present day China is facing its transition now, which distinguish itself from the western countries in that those countries had the social basis of Middle Class for their mature legal system while China has not. At present Middle Class is emerging in China and developing by leaps and bounds. However, Middle Class in China is still onion-head shaped since it takes up only a very small portion of the whole population. Great challenge is still ahead for the growth of Middle Class in China. The legal system construction relys on the support from Middle Class in China. In this sense, an all-round operation needs to be established to culture the required social surroundings and then make it the drive force in the promotion of China' s modern legal system. |
