The Fifteenth Congress introduced a new policy, Transparent Property Ownership, Clear Indication of Responsibility, Separation of Government and Enterprise, and Scientific Management, to establish the system of modem enterprise. In fact, since the end of 1970s, enterprise reform has been the centerpiece of economic reform of China, and the government has taken tremendous steps to achieve the reform by series of policies. Through share and management authority transfers in enterprises, reform of management and contract policies, and shareholder reforms, it has been years that the theory analysis in Chinese enterprise reform is focused on property ownership and management authority of an enterprise. Workers' enrollment in enterprise management, as the basic and important part of enterprise system, have been ignored. It has been shown that to enhance the management and quality of a business and to establish its modern enterprise system, the participating system will play an important role.On the one hand, under the new economic situations, knowledge, technology, innovation, management skills, and so on, have been playing important roles in the operations of an enterprise, and knowledge development and the innovations of technologies and management cannot proceed without the element—People.On the other hand, following globalization, China's entry in WTO; Chinese enterprise reform, and large quality of foreign investment coming into China, the lack of workers' enrollment in enterprise management has been revealed. Though Chinese laws state clearly that the state assures the master position of workers in a company, and the democratic management right of workers to abide by state laws, regulations, and company regulations, is protected by laws. However, there is a long way for us to establish and perfect the participating system.From the perspective of the law, this thesis introduces what is enterprise administration and summarizes the universal theories concerning workers and staff members' participating in enterprise management. And then it gives an in-depth analysis of the legislative practice, focusing on workers and staff members' participating in enterprise management. At last, the thesis points out the existing weakness in this system and offers some proposals for establishing and perfecting it. This thesis consists of four chapters except introduction and concluding remarks:Chapter One: A brief account of the Workers' enrollment in enterprise management. This chapter mainly focuses on theoretical basis participating of enterprise management and the development of the system. .Chapter Two: This chapter respectively introduces experience and practice of three typical forms : in American ,in Germany, and in Japan. It summarizes operation and management participating, supervising participating and capital participating.Chapter Three: Legislative status quo of workers and staff members' participating enterprise management in our country. This chapter discusses its establishment and development on the basis of our constitution, labor law and related enterprise regulations. Finally it points out the weakness in the existing participating system.Chapter Four: The process of improving the system of workers and staff members' participating. This chapter mainly gives some proposals on Workers' enrollment in enterprise management.
