Study Of The Sociology Of Law Of The Middle Kingdom Of Land Resources Disputes

In rural area the land resources disputes become the focus of the opposing campaign for their authority at present, which is also the critical problem effecting the social stability and development, construction of harmonious society, socialist political civilization and new rural areas construction. It holds far-reaching significance to research land resources disputes. Taking Gucun land resources dispute in G town, M county in western part of Hunan Province as an example, this paper expects that the application research of villager' s autonomy, actual operation of law and policy will be fruitful by the method of studying sociology of law. Based on the problems of natural environment, villages' pattern, economic and social patterns and land resources disputes in Gucun, the paper defines and expresses land resources disputes by sociology of law. For one thing, this paper describes the dispute of land which belongs to a woman who married in a village, which analyzes the background, process of this dispute, land rights, familial power, choosing off springs reasoning and so on. For another, by the method of studying sociology of law, this paper introduces the land disputes between Du and Li family, analyzing the games among families, village committees and town government, and discusses the application of law in rural areas. It puts forward rustic multiplex settlement mechanisms to solve problems by analyzing unsolved land disputes. It is believed that rustic multiplex settlement mechanisms is a systematic integration process, which also indicates that the cultural framework should be based on the legal institutionalization, multivariation, effectiveness, legal culture and value, while the social application framework should be based on the local resources of customs, morality and convention, and the institution framework should be based on integration and coordination of lawsuit. This paper expects to make progress from social application and sociology of law specially, not from the theoretic application on which at present some researchers mainly focus in land resources disputes.
