Sociology Of Law Of The Rural Society Of Civil Disputes Settlement Mechanism Study

In the contemporary Chinese rural society, people settle their conflicts and disputes according to various rules. The conflict between none-procedural settling disputes system and formal lawsuit forms the subject of people's law life. It also forces lawsuit, the law channel of national administration, into miscarriage. Therefore, understanding the actual situation of the contemporary rural society, studying the disputes realistically and their present settling situation, and setting up a set of systems of settling disputes with local conditions are significant to maintain the harmony and stability of rural society and to promote the further development of the rural society.Based on the former research achievements about pluralistic law, disputes and the settling theories, this essay tries to do some research from the angle of sociology of law. Consulting the countryside investigation materials, this essay inquires into various forms of settling civil disputes of the Chinese contemporary rural society, analyzes the significance and function of various ways of settling disputes, brings out the influences on the ways of people's settling disputes caused by the law resources of this rural society, the border district, and the view of rural society lawsuit, and raises the concept of amplifying the system of settling disputes, converting creatively traditional none-procedural settling disputes system and setting up a pluralistic settling dispute system.
