The Establishment And Improvement Of China 's Community Correction System

Community correction is one of the new patterns for non-violent offenders, which is widespread and proved effective in criminal-correction field abroad .It was based on profounding and wide theories, originated in 60-70 years of 20th centuries in western countries .In August of 2002,China started its partial experimental practice .Although a lot of achievement accomplished ,it still had many problems existed . This article focuses on the experiment in China and seeks to build the legal system of Community correction with China character through the introduction of its experience and development in foreign countries and analysis of the status as well as its defect in this practice in our country .The article firstly makes presentation of the Community correction's development in other countries and points out that it has been global trend in the legal correction field. Secondly, it generalizes the deficiency lying in the experimental practice to infer that it's urgently necessary to build systems and make perfections to make the resolution. Thirdly, it puts up with the countermeasure—to set up our Chinese Community correction system to take advantage of Community correction so as to make the transplant of the legal system successfully in China. It has four parts enclosed. The first part is the common knowledge of Community correction, which includes the definition, theory basis and history development .The second part expounds the necessities and the feasibilities of set up our Chinese Community correction system .The three part introduces the experimental-practice of Community correction in China, analyze its deficiency and problems, estimate the working value .The forth part expatiates on setting-up the Community correction system with Chinese character according to the pilot practice ,which contains the conception and legislation's renew ,staff and volunteer's organization ,the establishment of program's conduction and administration ,along with strengthening the community construction ,etc.
