Environment rights have become a new right concept since the environment crisis arisen. It was discussed and studied since early 1960's.Then it became the new content of human rights in environmental era. Some countries regulate environment rights in their constitutions in order to protect it and the environmental sources.This article want to seek the constitutional status of environment rights and study the presentations of environment rights in the basic environment law by studying the basic concept and character of environment rights and our country's environmental law legislate. We can find the way of our country's environmental law and enforce our consciousness of protecting environmentMy article consists of four chapters:Chapter 1 is the reason of environment rights was presented. There are two main reasons. One is the serious environment crisis, the other is the requirement of new concept of environmental rights, in order to more effectively protect environment. Environment rights are first studied by jurist of human rights in west Europe. In the push of UN, many countries accept it and protect it by law. If we want to protect our environment, we must study the environment rights.Chapter 2 is the basic theory of environment rights. In this section, the concept of environment in the law is defined. We can study the environment rights use this definition.If we want to understand the main of the environment rights, we must know the essences of the environment rights such as subject, object and nature of environment rights. In this article, the definition of the subject of environment rights is "human group". This definition include two parts, one is the now human, the other is the future human. The study about the object is by the way of environment economic. About the nature of the environment rights, this article think it is be included human rights.Chapter 3 is the theory of environment rights. There are three basic theories now in the world.
