The topic of this paper is about Marx's concepts of human rights,based on the studies of other scholars.Firstly,the author thinks that the concept of rights of man came into being in 17-18th century in Western Europe is composed of three factors,namely,the human concept of the Stoic school of philosophy, the right concept developed in ancient Rome and the duality concepts of politics of Christianity,that is important to get market economy or civil society into shape in Western Europe,and also is the base for us to understand Marx's concepts of human rights.Secondly,Marx thought that human existence is the trinity of the genus existence, colony existence and individual existence,as the general form, particular form and individual form of the human existence,and so,the human essence has three levels,the genus essence,social essence and individual essence;to correspond with it,Marx thought that the human rights is also the trinity of the genus rights, civil rights and individual rights.This kind of concept of human rights exceeds the rights of man of bourgeoisie.Thirdly, the author estimates Marx's concepts of human rights,that include(l)Mark's concepts of human rights don't have universality,because there is one falsehood that the development of economy is anti-democratic.(2)Marx definitely told us that the concepts of human rights have intense culture properties.(3)Owing to the external factors in history,Mark ignored individual rights in his theories.(4)the author thinks that human rights is not the objective but only a kind of means,its best function rests with its negatory value.Lastly,the author thinks that when the human rights system holds true in our country,the result engendered is uncertain and cannot be foreknowed.Thus,if human rights are regarded as not a kind of means but objective,as the criterion that weighs if one country is making progress,people are likely to understand falsely human rights,and fall into the trap that hides behind human rights.
