A Study On The Disciplinary Cause And System Of Judge In Our Country

Judge disciplinary reason, namely the judge punishment reason is the core and the foundation of judge disciplinary system. There are many problems in the judge disciplinary system in China for a long time. The unknowndisciplinary standards and disciplinary areas are the reasons.Hidden behind the specific problems is the lack of judicial independence and the idea of justice, and thus lead to the judicial practice of thechaos of the judge disciplinaryscene.Judge, asa legal practitioner, nottreated impartially further reveals our judge disciplinary systemare in urgent need of reform. This paper attempts to comparethe world’s developed countries’ judge disciplinary reasons, explain the common, combine with the actual situation of our country, and put forward our country judge punishment suggestions for reform of the subject, so that to drive theoverall improvement of disciplinary system.This paper mainly includes four parts: the first part, define the judge disciplinary reasons,confirm the value of philosophy in the punishment system andthe important status. So that to ascertain basic concepts and show the significance of disciplinary in the reform of the system of punishmentfor the following research;In the second part, we discover many similarities, provide advanced guidancefor our disciplinary subject reform; the third part I reveal our judge disciplinary chaos from two aspects of the text and practice analysis of our judge disciplinary status combined with the typical case; The fourth part combined with the advanced experience of the countries all over the world and actual conditions of our proposed the appropriate measures for the reform of our country. We should embodied philosophybased on the maintenance actions and the disciplinary subject reform in order to enhance the overalldisciplinary system eventually establish judge disciplinary system adapt to our judicialdevelopment stage.
