Research On Trade Union 's Safeguarding Labor Rights And Interests

Under the background of economic globalization, social production speeds as the quickening pace of the market, and the labor demand of enterprises is volatile. The world entered the era of elastic labor, instable economic and unstable jobs. In order to meet the elasticity of demand for labor, various flexible forms of employment arise at the historic moment, the labor dispatching is an important form of which. With the generalization of labor dispatch, the shortcomings and problems of labor dispatch expose constantly, and cause wide attention from all walks of life.As the legal voluntary union of the working classes, representing and maintaining legitimate rights and interests of workers is the basic responsibility of the trade union. To safeguard the legitimate rights and interests of dispatched workers can’t just rely on the government’s regulations and laws. We must play the role of trade unions fully, timely and effectively with a positive attitude under existing conditions. Therefore, the study of the role of trade unions under the labor dispatch has great practical significance for protecting the legitimate rights and interests of dispatched workers.Learning scholars both at home and abroad, on the basis of labor relations theory and organizational justice theory, this paper elaborates the role of trade unions from the maintenance of dispatched workers’unity rights, equal pay for equal work rights, democratic management rights, vocational training rights, to providing labor dispute mediation and legal aid. On this basis, the paper analyzes that the role of trade unions playing lacks solid foundation, rigid instruments and there’re worries when trade union cadres work. In view of the existing problems, drawing on the experiences and practices of developed countries, combining the reality of our country, this paper argues that China should guide and standardize the development of labor dispatching from different perspectives of law, policy, administrative, explore new labor dispatching union works, build workers strike system, perfect the relevant laws and regulations, to play the positive role of labor dispatching and reduce its negative effects.
