| The dispatched employment is one of unconventional and nonstandard labor relation. Because of having perfecting collocation of market resource and carrying out temporary work, the dispatched employment develops very quickly in China. At the same time, because employers use the dispatched employment to evade labor law and obligation, it causes some disputes.How to protect interests of dispatched workers? It is a problem we have to face with.The author think that union is an organization of protect workers. So the labor law must undertake the important task to protect interests of dispatched workers. Or else, single dispatched worker fight for their rights. The two sides seem like great disparity in strength. So the author from protect the weak one, standardize work relations, perfect the labor law, select Re-constructing the function of union under the system of dispatched employment to take the research object, hope through the paper elaboration, might clarify the impact that the dispatched employment lead to the function of union, how to realize the function of union under the system of dispatched employment overseas. Finally, it put forward to the author's proposal for the function of union.This paper is divided into six chapters. Chapter one clarify the background of the research, the goal of topic. Chapter two defines the concept and characters of dispatched employment, system evolution, based on collecting information, summarizing advantage and disadvantage of dispatched employment, following give the author's idea if dispatched employment gained legal and effective restriction, it will produce positive effect. Chapter three analyses the disfigurement of the function of the union under dispatched employment and the reason it cause. Chapter four take American, France, Taiwan for example, analyses the situation of lawmaking of dispatched employment in these countries and district. Chapter five puts forward to legal suggestions, basing on analyzing the status quo of dispatched employment and general idea of dispatched employment. Chapter six summarizes the paper.In view of the fact that the author theoretical level and the practice ability limit, has not still been able to discuss some questions in dispatched employment.
