On The System Of Declaring Officials' Property

The property declaration system originated and developed in the West, the property declaration system was known as the "Sunshine Act", it has been successful in many countries around the world and proved to the terminal mechanism of cure corruption.China has not yet established a property declaration system in the true sense, conduct a comprehensive study to the property declaration system in order to provide theoretical support to the property declaration system of our country.Establish and improve the property declaration system are of great significance to the China’s anti-corruption and clean government undertakings. Establish property declaration system has its inevitable legal basis, and that is the principle of popular sovereignty, the priority on the public interest and democratic supervision theory. For the establishment of property declaration system, China’s central government and local governments have carried out effective exploration.In 1995, "the requirements of party and government organs leading cadres which above the county (division) level need to report income",requiring leader to report the personal income to the personnel department in every half-year, which is the first property declaration documents in China, it propose implement declaration to the income of Chinese officer in the first time.Today,we implemented the "the provisions of leading cadres report the personal matters"which published in 2010 and the "the provisions of the provincial and ministerial level leading cadres report the domestic property (Trial)" which published in 2001. These two requirements on behalf of China’s property declaration system.In local,government are also actively exploring the property declaration system, such as Aletai, Cixi, Liuyang, Yinchuan and so on.This paper analysis the two requirements, revealing the problems of property declaration system,it analyzes the plight of the property declaration system, and that is no legislation in property declaration system, the property declaration system is imperfect,the through of "official position"is strong and the obstruction of the vested interest groups,the boundary between open the property and personal privacy is no clear, related measures are imperfect,the obstruction of the political and social stability factors.Through comparative analysis, introducing the property declaration system of the United States, France, South Korea and Russia in order to provide inspiration to the property declaration system of our country As for the problems of the property declaration system, this paper pointed out the future approach to the property declaration system of our country, including legislation in property declaration system,improve the property declaration system,strengthen the education of law culture and limit the privacy of officer,improve the related measures,step by step and implement in order.I believe this five-pronged approach will be able to solve the problems of the property declaration system and lay the foundation for the establishment of the property declaration system.Meanwhile, the government should learn from foreign theory, institutional practices and base on the national conditions and cultural traditions to establish the property declaration system with Chinese characteristics.In short, we should be implemented the property declaration system as soon as possible, making it turn into a powerful weapon to curb the corruption.
